Terms of Service for DracoByte Minecraft Server Hosting

Welcome to DracoByte! These Terms of Service ("Terms") govern your access to and use of our Minecraft server hosting services ("Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By using our Services, you signify your acceptance of these Terms and our Privacy Policy. If you do not agree, you may not use our Services.

2. Description of Services

DracoByte provides free and paid hosting solutions for Minecraft servers, including but not limited to server setup, maintenance, technical support, and network infrastructure.

3. Account Registration and Security

You must be at least 13 years of age to register. You agree to provide accurate information and keep your account secure. You are responsible for all activity on your account.

4. Acceptable Use Policy

You agree not to use the Services to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Upload harmful, abusive, or illegal content
• Host or distribute malware, exploits, or hacking tools
• Send spam or unauthorized promotions
• Interfere with service operation or other users’ servers
• Attempt unauthorized access to systems
• Run resource-heavy or abusive processes beyond plan limits

5. User Content Responsibility

You are solely responsible for all files, data, and content uploaded, stored, or transmitted through our Services. DracoByte does not actively monitor user content but reserves the right to remove content or suspend accounts that violate these Terms or applicable law. You agree to indemnify DracoByte for any claims arising from your content.

6. DMCA & Copyright Complaints

If you believe your copyright has been infringed, please send a DMCA takedown notice to support@dracobyte.pro or see our DMCA Policy. We will respond to valid requests and may remove infringing content without notice.

7. Billing and Payments

Paid Services are billed on a recurring basis. Payments are due by the due date. Payment processing is handled by third-party providers; DracoByte does not store sensitive payment data.

7A. Refunds & Cancellations

DracoByte services are billed in advance and are generally non-refundable except where required by law. By purchasing a paid plan, you acknowledge and agree to the following:

• No pro-rata refunds: We do not provide partial or pro-rated refunds for unused time within a billing cycle.
• Cancellation timing: You may cancel at any time via the Client Area. Cancellation takes effect at the end of the current billing period unless you select “Immediate.”
• Free tier: Free servers and any add-ons granted as promotions are not eligible for refunds or cash value.
• Abuse/ToS violations: Accounts terminated for violations of these Terms are not eligible for refunds.
• Chargebacks: Initiating a chargeback or payment dispute may result in immediate service suspension and account review.
• Service credits (if applicable): Any goodwill credits or SLA credits are issued as account credit only and have no cash value.

8. Free Plan Limitations

Free tier servers are subject to limitations to prevent abuse. These may include reduced performance, automatic suspension after inactivity, and restrictions on resource-intensive usage.

Each user is allowed only one free server. Any additional servers created after the initial free server — including those created through alternate accounts — will be removed without notice and with no chance of recovery.

9. Service Uptime and Support

We strive for high uptime but do not guarantee uninterrupted service. Support is provided via our designated channels during business hours.

10. Data Backup and Loss

You are responsible for backing up your data. DracoByte does not guarantee data recovery in the event of data loss.

11. Termination of Service

We may suspend or terminate access to our Services at any time for violations of these Terms or for any other reason, with or without notice.

12. Disclaimer of Warranties

Our Services are provided "as is" without any warranties of any kind. We do not guarantee error-free operation or availability.

13. Limitation of Liability

DracoByte is not liable for indirect, incidental, or consequential damages, including but not limited to data loss, downtime, or unauthorized access.

14. Indemnification

You agree to indemnify and hold DracoByte harmless from any claims, damages, or liabilities arising from your use of the Services or violation of these Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Illinois, United States. Any disputes shall be resolved in the courts located in Cary, Illinois.

16. Changes to Terms

We may modify these Terms at any time. Material changes will be notified at least 30 days in advance.
